Terms of Service

These Terms of Service govern access to Nuvis, the website, and related services.

1. Subject and general provisions

This Agreement governs the relationship between FOP Lontkovskyi Serhii Andriiovych, a sole proprietor registered and operating under the laws of Ukraine, registration number 3397414452, the administrator of the Nuvis service, and the User regarding the use of Nuvis, including software and other services provided through the service.

The date of conclusion of this Agreement is the date when the User starts using the service. A User is any individual who uses the service on a paid or free basis, regardless of whether registration was completed.

Nuvis consists of the nuvis.ai website and any related interfaces through which the User may obtain access to software and related services. Access may be limited or changed at the discretion of the Administrator, partners or copyright holders.

The Privacy Policy is an integral part of this Agreement and is posted at https://nuvis.ai/privacy-policy. By using Nuvis, sending registration forms, providing information or taking any other actions described in the service interface, the User fully and unconditionally accepts this Agreement.

2. User rights, obligations and guarantees

The User undertakes to use Nuvis only for personal non-commercial purposes, to comply with this Agreement and not to violate the rights or legitimate interests of the Administrator or software copyright holders.

The User must regularly review this Agreement and its updates. Continued use of the service after changes come into force means unconditional acceptance of those changes.

By starting to use Nuvis, the User confirms that the User has reached the minimum age required in the User's country for access to the relevant software and, where required, for making payments.

The User must not bypass technical restrictions, copy software, interfere with territorial access restrictions, destabilize the service or use contact details in violation of this Agreement. The Administrator may request the User's phone number for payment security and service communications.

3. Administrator rights, obligations and guarantees

The Administrator may unilaterally change this Agreement, suspend or terminate access to the service in case of violations, collect and process Users' personal data in accordance with the Privacy Policy and send informational messages about Nuvis updates.

The Administrator may change the functionality of the service without prior notice unless a change materially affects Users' rights, and may transfer rights and obligations under the Agreement to third parties while notifying Users in the prescribed manner.

The Administrator undertakes to provide the service in accordance with this Agreement and applicable law, ensure the confidentiality and security of Users' data, provide technical support within reasonable timeframes and inform Users about relevant changes in service provision.

4. Responsibility of the parties

A party that fails to fulfill or improperly fulfills obligations under this Agreement bears responsibility in accordance with applicable law and must compensate the other party for documented damages caused by such breach.

The Administrator may suspend, restrict or terminate access to Nuvis if the User violates this Agreement, applicable law or acts unfairly, disrupts the service or harms the rights, interests or reputation of the Administrator or software copyright holders.

The User is personally responsible for actions related to the use of Nuvis and the posting of comments or other information through the service.

Access to Nuvis is provided "as is". The Administrator does not guarantee that the service will meet every User expectation and is not liable for third-party content, advertising content, technical failures outside its reasonable control or damage caused by illegal or improper use of the service.

5. Registration and user account

To pay for access to software, subscribe to services, participate in loyalty programs or receive technical support, the User may be required to register and create an account.

Registration or authorization may be carried out by email and password, by a one-time code sent to email or phone, or through an eligible social network account if such a method is available in the interface.

The User may not create more than one account for the same email address or phone number, must keep account credentials secure and must immediately notify the Administrator about any unauthorized use of the account.

The user account allows the User to manage personal information, control access periods and payment history, review bonuses or gifts where available and perform other actions described in the Agreement.

6. Access to software, subscriptions and payments

Nuvis may provide free access, one-time access, subscription access and access to collections. Paid access may vary in cost, duration, functionality and availability depending on the selected product and device.

Paid access is considered provided from the moment payment is reflected in the Administrator's payment accounting system or from the moment an access code is activated. After the paid period ends, the corresponding software becomes unavailable unless the User renews access.

Paid access may be one-time, trial-based, or recurring depending on the selected plan. The applicable price, billing interval, and renewal settings shown in the checkout or account interface at the time of purchase apply to that order. If pricing changes, the Administrator notifies the User through the interface and/or email where available.

The User may refuse to renew subscription access at any time by using the "Cancel Subscription" button in the "Subscription Management" section of the User account and following the service instructions. Access for that subscription ends on the day following the last day of the paid period, and no charge for the next period is made.

If a refund is approved for an unused period of software access, funds are credited to the same payment card or payment method used for the original payment. The refund procedure may take from 3 to 14 business days depending on the payment system and the issuing bank.

The Administrator may offer promo codes and promotional offers. At the Administrator's discretion, promo code activation may require registration, adding a bank card, providing phone or email details, or may be limited to new users only.

7. Technical requirements

Access to Nuvis is provided subject to the technical requirements stated in this Agreement and in the service interface. The User accesses the service through devices connected to the User account.

The service may be unavailable or have limited functionality when devices do not meet the technical requirements, when outdated or unsupported software is used, or where other restrictions apply. The User may generally use up to five simultaneous sessions per account unless a lower limit is set for a specific software product.

The User is responsible for internet access, device setup and compatible software. Nuvis is not responsible for damage to the User's hardware or software caused by or connected with the use of the service.

8. Additional terms and governing law

The current version of this Agreement is available at https://nuvis.ai/terms-of-service. The Agreement is governed by the laws of Ukraine and remains in force for an indefinite term from the moment the User starts using the service.

Disputes, disagreements, claims and complaints are first to be resolved through negotiations. If the parties cannot reach agreement, the dispute is subject to resolution by a court at the Administrator's location in accordance with applicable law.

If any term of the Agreement is invalid, the remaining terms remain valid. Headings are used for convenience only and do not affect interpretation.

For questions, notices, proposals or complaints regarding Nuvis, the User may contact the Administrator at info@nuvis.ai. In case of discrepancies between language versions, the Ukrainian text prevails.
